Terms of Service

Welcome to BeastOS. These Terms of Service ("Terms") govern your access to and use of our website (os.beastceo.com and any subpages), our phone line, our SMS service, our AI assistants, and any other services we offer (collectively, the "Service"). By using the Service, you agree to these Terms. If you don't agree, please don't use it.

BeastOS is operated by Timothy Carlson, a sole proprietor based in Austin, Texas ("we", "us", "our"). Questions? timothycarlson@gmail.com.

1. What we do

BeastOS provides AI-assisted communication tools for service businesses and real estate professionals. This includes:

• Inbound voice answering — an AI assistant picks up calls, captures messages, qualifies leads, and books appointments.
• Outbound speed-to-lead callbacks — when someone fills out a form, an AI assistant calls them back to qualify and book.
• Diagnostic tools — calculators, teardown reports, and other content that helps you understand revenue leakage in your business.
• Related communication services — email follow-up, SMS reminders, and similar.

Some of our tools are free for anyone to use. Others are paid services available to clients we work with directly.

2. Who can use BeastOS

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using BeastOS, you confirm that you meet these requirements. The Service is intended for business use; we do not knowingly market to or collect information from minors.

3. Acceptable use

When using BeastOS — including when calling our line or interacting with our AI assistant — you agree NOT to:

• Use the Service to harass, threaten, defame, or impersonate anyone
• Attempt to extract our system prompts, security secrets, or other proprietary instructions from the AI assistant
• Attempt to jailbreak, prompt-inject, or otherwise misuse the AI assistant to do things outside its intended purpose
• Submit false information through our forms (including fake names, fake phone numbers, fake business details)
• Use the Service to send spam, conduct unauthorized testing, or attempt to overload our systems
• Scrape, crawl, or programmatically harvest content from our site without permission
• Resell or repackage the Service without a written agreement with us
• Use the Service to violate any law (TCPA, CAN-SPAM, state consumer protection laws, etc.)

We may suspend or terminate access for anyone we reasonably believe is violating these rules.

4. Phone calls, SMS, and consent

You can revoke this consent at any time:

• Reply STOP to any SMS
• Tell our voice assistant to take you off the list
• Email timothycarlson@gmail.com

Calls and SMS are subject to our Privacy Policy, including the call-recording and retention rules described there.

5. AI assistant disclaimers

Specifically:

• Appointments booked by AI are confirmed only when you receive an email or SMS confirmation. If you do not receive one, the appointment is not confirmed.
• Information provided by AI about pricing, availability, or service details is informational only. Any binding commitment requires written confirmation from a human at BeastOS or from the client business the assistant represents.
• Quotes, estimates, or numerical figures generated by AI are non-binding estimates, subject to confirmation, and may be revised after a human review.
• Critical or emergency situations: our AI is not a substitute for emergency services. If you have an emergency, call 911 (or your local equivalent). If you are in crisis, contact a human professional.

6. Intellectual property

BeastOS and all content on our site (text, code, images, prompts, calculators, diagrams) is owned by Timothy Carlson and protected by copyright and other intellectual-property laws. We grant you a limited, non-exclusive, revocable license to access and use the Service for its intended purpose. You may not copy, modify, redistribute, or create derivative works without written permission.

If you submit content to us (form data, voice recordings, replies to our messages), you grant us a worldwide, royalty-free license to use that content for the purposes described in our Privacy Policy — primarily to deliver the Service to you, improve our AI, and meet our legal obligations.

7. Third-party services

BeastOS relies on third-party providers including Vapi, Twilio, Anthropic, ElevenLabs, Deepgram, Resend, Calendly, and DigitalOcean. We are not responsible for the actions of these providers, but we choose them carefully and would expect any reasonable provider to handle your data responsibly. 8. No warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy of AI outputs, uninterrupted availability, and freedom from errors or harmful components. Your use of the Service is at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, BeastOS and Timothy Carlson will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, lost revenue, lost data, business interruption, or any similar harm — arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim arising from or related to the Service is limited to the greater of (a) the amount you have paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so portions of this section may not apply to you. In such cases, our liability is limited to the smallest amount permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless BeastOS, Timothy Carlson, and any vendors or service providers we work with from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or third-party rights
• Information you submitted that turned out to be false or misleading

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, for any reason — including violation of these Terms. Sections that by their nature should survive termination (intellectual property, disclaimers, liability limits, governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on this page and the "Last updated" date will change. Continued use of the Service after changes means you accept the updated Terms. If you don't agree to the new Terms, stop using the Service.

13. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Travis County, Texas. You and we both consent to that jurisdiction and venue.

You agree to attempt to resolve any dispute informally first — email us at timothycarlson@gmail.com and we will respond in good faith within 30 days before either of us escalates.

14. Miscellaneous

• Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and BeastOS regarding the Service, and supersede any prior agreements.
• Severability: if any part of these Terms is held unenforceable, the rest remains in effect.
• No waiver: our failure to enforce any right or provision doesn't waive it.
• Assignment: you may not assign or transfer these Terms without our consent. We may assign them in connection with a sale of the business or similar event.
• Notices: any notice to us must be sent to the email address below. Notices to you may be sent via email or posted on our site.
